Navigating the criminal record process in Arizona can be confusing, especially when terms like “set aside,” “expungement,” and “record sealing” are often used interchangeably. In reality, Arizona law treats these options very differently — and understanding the distinction can help you choose the right path forward.
What a Set Aside Really Does
Under A.R.S. § 13‑907, Arizona allows many people with past convictions to apply for a set aside once they have completed all terms of their sentence. A set aside updates your record to reflect that your conviction has been legally set aside and that you’ve satisfied the court’s requirements.
While employers and landlords may view a set aside positively, it’s important to know that the conviction does not disappear. It remains visible on background checks, but with the added note that the court considers the matter resolved.
Limitations of a Set Aside
Not every offense qualifies. Crimes involving serious physical injury, the use of a deadly weapon, certain sexual offenses, and offenses involving victims under 15 are generally ineligible. DUI and traffic-related cases have their own special rules as well.
Expungement and Record Sealing in Arizona
Unlike many states, Arizona does not offer broad expungement or record sealing for most criminal convictions. The only true form of expungement available is through Proposition 207, which allows certain marijuana-related offenses to be completely cleared from your record.
Eligible marijuana cases — such as possession of under 2.5 ounces, possession of up to six plants, or certain paraphernalia charges — can be fully expunged, meaning they are removed from public view and no longer appear on most background checks.
Which Option Is Right for You?
If your goal is to demonstrate rehabilitation and improve employment opportunities, a set aside may still provide meaningful benefits. If your case involves a marijuana offense covered by Prop 207, expungement offers a much stronger level of relief because it fully seals the record.
