Receiving a Notice to Appear (NTA) from Immigration and Customs Enforcement (ICE) can be overwhelming, confusing, and frightening. An NTA means the government has initiated removal (deportation) proceedings against you, and you will be required to appear before an immigration judge. But it does not
mean you are being deported immediately—and you still have rights and options.
What Is a Notice to Appear?
An NTA is a charging document that explains why the Department of Homeland Security believes you are removable from the United States. It includes:
- Your personal information
- The legal reasons DHS says you are deportable
- Your obligation to appear in immigration court
- The address of the court (or a note that will follow)
Once the NTA is filed with the immigration court, your case begins, and you will be assigned hearing dates you must attend.
What You Should Do Immediately
If you receive an NTA, take these important steps:
- Do not ignore it. Missing a court hearing can result in an automatic order of removal.
- Read the charges carefully. They may be incorrect or incomplete.
- Contact an experienced immigration attorney right away. Removal defense is complex, and the government is already building its case.
- Keep the NTA and all documents together. Bring them to your attorney.
Do You Have Options?
Absolutely. Many people facing removal are still eligible for relief, including:
- Adjustment of status
- Asylum or withholding of removal
- Cancellation of removal
- Waivers for certain grounds of inadmissibility
- U visa or VAWA protection
- TPS or other humanitarian options
An attorney can analyze your immigration history, family situation, and possible defenses to determine the best strategy.
